Moser v. Trans-General Life & Casualty Group, 2000 U.S. App. LEXIS 18154 (9^th Cir. Jul. 24, 2000)(Unpublished)-This court reversed the district court's sua sponte summary judgment against Moser on her claim for long-term disability benefits.  Trans-General abused its discretion when it prematurely terminated her 60-day appeal period insofar as it refused to consider a letter from Moser's treating physician, which clearly supported her coverage claims.  This court directed the district court to enter judgment for Moser.
